Spark Car Wash Text Message/SMS Terms and Conditions

By opting in to receive text messages (the “SMS Service”) from Spark Car Wash (“Company,” “we,” “us,” or “our”), you agree to these Text Message/SMS Terms and Conditions (the “SMS Terms”). You may opt in by texting START. Your participation in the SMS Service is also subject to our Privacy Policy and Terms of Use, found https://sparkcarwash.com/privacy-policy/ and https://sparkcarwash.com/terms-conditions/. These SMS Terms are not intended to modify the Privacy Policy or Terms of Use that otherwise govern the relationship between you and the Company.

1. Opt In and Opt Out: You may sign up recurring text messages from us by filling the relevant registration forms. Your consent to receive automated texts is completely voluntary. You may opt out at any time. To opt out of text messages, reply STOP, CANCEL, UNSUBSCRIBE, END, or QUIT, or email us at info@sparkcarwash.com and state that you wish to opt out of SMS marketing. You acknowledge and agree to accept a final SMS or text message from us confirming the opt-out.
2. Your Consent to Receive Automated SMS/Text Messages: You acknowledge that by voluntarily providing your telephone number(s), you expressly agree to receive recurring automated text messages (such as SMS, MMS, or successor protocols or technologies) from us concerning the marketing or sale of our services, products, promotions, offers, and/or events, and your relationship with us, including your orders, inquiries, or communication with us. You understand that consent is not required to make purchases from us. 
3. Message Rates: You acknowledge and agree that message and/or data rates may apply. Text/SMS message frequency will be not more than four (4) times per month. 
4. Providing Phone Numbers: You hereby verify that the mobile number provided by you to us is true, accurate, and your own. You further verify that you are the current subscriber or owner of any telephone number that you provide. Should any of your contact information change, including ownership of your telephone numbers, you agree to immediately notify us before the change goes into effect by email to info@sparkcarwash.com. 
5. Indemnification: You agree to indemnify us for any privacy, tort, or other claims, including any claims under the Federal Telephone Consumer Protection Act (or any state law equivalent), including claims related to your provision of a telephone number that is not owned by you and/or your failure to notify us of any changes to your number. You hereby agree to indemnify, defend, and hold us harmless from and against any and all such claims, losses, liability, costs and expenses. 
6. Age Verification: By participating in the SMS Service, you acknowledge and agree that you are 18 years of age or older. You must have your own wireless device that is capable of two-way messaging, use a wireless carrier, and be a wireless service subscriber with text messaging service. Check your phone capabilities for specific text messaging instructions, and check with your provider to determine whether your provider carries the necessary service to participate in our SMS Service. 
7. Miscellaneous: You represent and warrant to us that you have all necessary rights, power, and authority to agree to these SMS Terms and perform your obligations hereunder, and nothing herein or in your performance of such obligations will place you in breach of any other contract or obligation. If any provision of these SMS Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the SMS Terms will otherwise remain in full force and effect and enforceable. We reserve the right to change the SMS Terms from time to time. Any updates to the SMS Terms shall be posted or otherwise uploaded to the Website. You acknowledge your responsibility to review the Website and these SMS Terms from time to time and to be aware of any such changes. Your continued participation in the SMS Service after any such changes constitutes your acceptance to these SMS Terms, as modified. 
8. Carriers: The SMS Service is available via participating carriers. Reach out to your carrier to confirm you are eligible to receive the SMS Service. 

The SMS Service is not compatible with all cell phone models or carriers. We are not responsible for any delays upon sending or receiving text or SMS messages.
